We at Clutch Shipper respect your concerns about privacy.
This Privacy Notice describes the types of personal information we collect about consumers, how we may use the information and with whom we may share it. The notice also describes the measures we take to safeguard your personal information. In addition, we tell you how you can ask us to (i) access or change the personal information we maintain about you, (ii) withdraw consent you previously provided to us, (iii) refrain from sending you certain communications, and (iv) answer questions you may have about our privacy practices.
This Privacy Notice is not a contract and does not create any contractual rights or obligations.
Our privacy practices may vary among the countries or territories in which we operate to reflect local practices and legal requirements.

This Privacy Notice applies to you if you fall into one of the following categories: (i) a Clutch Shipper customer; (ii) an end recipient of services provided by Clutch Shipper; (iii) a Clutch Shipper supplier; (iv) a customer of a third-party service that links to our website or this Privacy Notice; or (v) if you contact us via our website, social media, or email. Generally, this Privacy Notice applies to our sites, products and services (collectively, "Services"), including Services that link to this Privacy Notice. It also applies when you interact with our advertisements and applications on third-party websites and services if those applications or advertising include links to this Privacy Notice.
We are not responsible for any of the content or privacy practices of any third-party sites or services. Any data that is collected by any linked third-party site will be governed by that third party's applicable privacy notices and its terms of use. We encourage you to read them.
We may supplement this Privacy Notice through one or more supplemental privacy notices, which apply to a particular interaction with us or our Services. These supplemental privacy notices may be either embedded in this Privacy Notice or made available to you separately. We will tell you when a supplemental privacy notice applies.
For legal purposes, including under GDPR (General Data Protection Regulation), Clutch Shipper may be a controller or processor of all Personal Information subject to this Privacy Notice for our Services.
2. Information We Obtain
We may obtain consumer personal information (such as name, contact details and address) in connection with various activities, such as (i) use of the Clutch Shipper website and applications, (ii) shipping activities, including delivery and collection of shipments, (iii) requests to track shipments or answer questions, (iv) events in which we participate, (v) promotions and other offers, and (vi) calls placed with customer service which may be recorded.
The types of personal information that we may obtain include:
- Individual and business contact information (such as name, company name, physical address, email address, and telephone number)
- Shipping information, (such as (i) shipping-related contact details like the sender's and consignee's, physical address, email address and telephone number, (ii) signature for proof of delivery, (iii) Clutch Shipper account number and (iv) information given to us that helps us access locations to which we provide service) and information provided to us regarding the content of certain shipments, but only to the extent an identifiable person can be linked to such content.
- Information that enables us to verify an individual's identity
- Names, email addresses and telephone numbers of others to whom we are asked to send information
- Information provided in response to surveys
- Username, password and other credentials used to access Clutch Shipper products and services
- Other personal information that may be provided to us to obtain a Clutch Shipper product or service
We also receive consumer personal information from our customers in order to perform services. We may receive personal information from third parties, including public databases, social media platforms, commerce platforms, or third-party partners such as analytics or marketing providers
In addition, when you visit our websites, use our apps or interact with Clutch Shipper-related tools, widgets or plug-ins, we may collect certain information by automated means, such as cookies and web beacons. The information we collect in this manner includes IP address, unique device identifier, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken, and dates and times of activity. A 'cookie' is a text file that websites send to a visitor's computer or other Internet-connected device to uniquely identify the visitor's browser or to store information or settings in the browser. A 'web beacon' also known as an Internet tag, pixel tag or clear GIF, links web pages or apps to web servers and may be used to transmit information back to a web server. Through these automated collection methods, we obtain and store 'clickstream' data to tell us usage patterns. We may link certain data elements we have collected through automated means, such as your browser information, with other information we have obtained about you to let us know, for example, whether you have opened an email we sent to you. We also use third-party analytics tools that collect information about visitor traffic on our websites or apps. Please note, however, that without cookies you may not be able to use all the features of our websites or apps. Both we and others (such as our advertising networks) may collect personal information about our visitors' online activities, over time and across third-party websites, when using our websites and apps.
3. How We Use the Information We Obtain
We may use the information we obtain to:
- Provide products and services you request
- Provide customer support and respond to and communicate with you about your requests, questions and comments
- Send you tracking updates (from Clutch Shipper and/or our business partners) and help you select convenient delivery options
- Establish and manage your Clutch Shipper account (including your online account on clutchshipper.com and its various features)
- Offer you products and services that we believe may interest you
- Process claims we receive in connection with our services
- Operate, evaluate and improve our business (including developing new products and services; managing our communications; determining the effectiveness of our sales, marketing and advertising; analyzing and enhancing our products, services, websites and apps; ensuring the security of our networks and information systems; performing accounting, auditing, invoicing, reconciliation and collection activities; and improving and maintaining the quality of our customer services)
- Perform data analyses (including market and consumer search and analytics, trend analysis and profiling, financial analysis and anonymization of personal information)
- Protect against, identify and prevent fraud and other prohibited or illegal activity, claims and other liabilities
- Comply with applicable legal requirements and our policies
- Establish, exercise and defend legal claims
- Monitor and report compliance issues
In addition, we use information collected online through cookies, web beacons and other automated means for purposes such as (i) customizing our users' visits to our websites and apps, (ii) delivering content (including advertising) tailored to our users' interests and the manner in which our users browse our websites and apps, (iii) improving website functionality and user experience, (iv) debugging, identifying, and repairing errors that impair the intended functionality of our websites, (v) providing customer service and support, and (vi) managing our business. We may supplement data we collect through automated means with information about your location (such as your postcode) to provide you with content that may be of interest to you.
4. What you can do to manage your privacy
You have a choice about the use of your Personal Information, including information that identifies you, marketing communications you receive from us. How you can access and control information that identifies you will depend on which Services you use. You can view and edit information that identifies you online through your Clutch Shipper Account.
- Updating Your Personal Information. In connection with your right to manage your Personal Information you provide to us, you may access, update, change, correct or request delivery or deletion of your information either through the Service or through our customer support. You can reach our customer support by using the contact information provided in the "How to Contact Us" section of this Privacy Policy. We will respond to your request within a reasonable time frame, but we may not accommodate a request to update any such data if we believe it would violate any law or legal requirement, or would cause the data we hold to be incorrect.
- Managing Marketing Communications from Us. If you have signed up for our commercial emails, we will honor your choices when it comes to your communications preferences. You have the following choices if you have been receiving marketing communications from us that you no longer wish to receive:
- If you have signed up for commercial emails or newsletters, you may unsubscribe by accessing the opt-out link included at the bottom of the email or by contacting us.
- If you have signed up to receive text messages from us, you may opt out of these alerts any time by replying "STOP" or any alternative keyword we share with you.
- Social Media Features. Our Services may use social media features, such as Facebook sharing ("Social Media Features"). These features may collect your IP address and which page you are visiting within our Service, and may set a cookie to enable the feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing the relevant Social Media Features.
Please allow sufficient time for your preferences to be processed. Please also remember that even if you choose not to receive marketing communications from us, we may contact you for other purposes (such as responding to your requests, sending you mandatory service or transactional communications, or for other administrative purposes).
Residents in certain jurisdictions may have additional rights with respect to accessing and to having amended, delivered or deleted any Personal Information. 5. Data Retention
In accordance with and as permitted by this Privacy Notice, applicable law and regulations, we will retain your information as long as necessary to carry out the purposes outlined in this Privacy Notice (or any other notice provided to you at the time your information is collected), including to serve you, to maintain your account for as long as your account is active, or as otherwise needed to operate our business. When you close your Clutch Shipper Account, we may continue to communicate with you as permitted by this Privacy Notice, unless you have opted out of receiving marketing communications. We may also retain and continue to use some of your information as permitted by this Privacy Notice, including for business purposes and to improve our offerings or to develop new ones, and as required by applicable law and regulations and Clutch Shipper's records and information management policies to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete any outstanding transactions, and for the detection and prevention of fraud.
6. How We Protect Personal Information
We maintain administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Although we take steps to limit access to our systems and facilities to authorized individuals, information that is located on the outside of a parcel or letter may be visible to others, so in that scenario we cannot guarantee the security of your Personal Information and encourage you to use caution when using the Internet. 7. Access and Correction
Subject to the requirements and limitations of applicable law, (i) you may obtain a copy of certain personal information we maintain about you or update or correct inaccuracies in that information through your clutchshipper account on clutchshipper.com or (ii) you may have the right to obtain access to personal information we maintain about you by contacting us as indicated in the 'How to Contact Us' section of this Privacy Notice. To help protect your privacy and maintain security, we will take steps to verify your identity and/or may ask you to provide other details before granting you access to the information. In addition, if you believe that personal information, we maintain about you is inaccurate, subject to applicable law, you may have the right to request that we correct or amend the information by contacting us as indicated.
8. International Data Transfers
In accordance with and as permitted by applicable law and regulations, we reserve the right to transfer your information, including your Personal Information, process and store it outside your country of residence to wherever we or our third-party service providers operate. As provided in this Privacy Policy, we may also allow employees and service providers to access your Personal Information globally. By using the Services or providing Personal Information for any of the purposes described in this Privacy Policy, you acknowledge that your Personal Information may be transferred to or stored in such locations.
9. Children's Privacy
Our Services are intended for and directed to adults. Our Services are not directed to minors (people under the age of 13 or the equivalent minimum age, depending on jurisdiction) and we do not knowingly collect any information, including Personal Information, from minors. IF YOU ARE UNDER 16 YEARS OLD, YOU ARE A MINOR IN MANY JURISDICTIONS. If we make material changes to the way we process your Personal Information, we will provide you appropriate notice, including via our Service or by other communication channels, such as by email or posting on our Site. We encourage you to periodically review this page for the latest information on our privacy practices. Please review any changes carefully. If you object to any of the changes and no longer wish to use our Services, you may close your account(s). All changes are effective immediately upon posting and your use of our Services after a notice of material change or posting of an updated Privacy Notice constitutes your acknowledgment that you have read and understand the updated Privacy Policy, and that you understand and consent to the ways that we will collect, use and share data, including Personal Information, as stated therein.
12. YOUR U.S. STATE PRIVACY RIGHTS.
Depending on the U.S. state where you reside, you may have certain additional privacy rights, subject to statutory limitations.
- Right to Know and Access: You may have the right to request information about the Personal Information that we collect, use, disclose, share and sell. This includes the ability to request the specific pieces of Personal Information we have collected about you. If you would like to access your Personal Information or receive information about the categories of Personal Information about you that we have shared as described in this Privacy Policy, please contact us via email, with your request. We will use your email address to verify your request and communicate with you regarding your request.
- Right to Delete: You may have the right to request that we delete certain Personal Information that we have collected from you, under certain circumstances. If you would like us to delete your Personal Information, please email us a deletion request. You will need to provide us with certain Personal Information requested by our team so that we may verify your request and communicate with you regarding your request.
- Right to Correct: You may have the right to request that we correct any inaccurate Personal Information that we hold about you.
- Right to Opt Out of Sales and Sharing or Using for Targeted Advertising: You may have the right to direct us not to sell or share your Personal Information and to opt out of certain targeted advertising where information is processed across unaffiliated or differently branded websites and applications.
- Right to Limit the Use of Sensitive Information: You may have the right to request that we limit the use and disclosure of sensitive information to certain purposes permissible under applicable law. We do not collect any sensitive information.
- Right to Opt Out of Profiling that Produces Legal or Similar Effects: We do not profile individuals for purposes to which this right applies.
- Right to Non-Discrimination: Should you wish to request the exercise of your rights with respect to Personal Information, we will not discriminate against you by offering you different pricing for products or services, or by providing you with a different level or quality of products or service, based solely upon this request and subject to certain applicable exceptions. We are permitted to change our service level or change the rate we charge if that change is reasonably related to the value of your information. Please note that we need to retain certain types of Personal Information to continue providing our services (e.g., name, address). Without your Personal Information, we will not be able to provide you with the requested services.
These rights are not absolute, are subject to exceptions and limitations and may not be afforded to residents of all states. If any of the above rights are available to you under applicable law, you may submit a request to exercise those rights through any of the methods described under the "How to Contact Us" heading of the Privacy Policy. If your request is denied, applicable law may provide you the right to lodge an appeal with us. The response to your rights request will inform you of any appeal rights you may have and tell you how you may exercise them.
California Privacy Rights
If you reside in California, we are required to provide additional information to you about how we use and disclose your Personal Information. You may also have additional rights with regard to how we use your Personal Information. We have included this information below.

If you are a California resident, you may request that we disclose a list of all third parties with whom we have shared your "personal information" (as defined by California's "Shine the Light" law) during the previous calendar year, along with the type of personal information that we disclosed. Exercising Your Opt-Out Rights (Do Not Sell or Share My Personal Information).
